These terms govern the use of Nuncie (https://nuncie.com and https://app.nuncie.com), offered by Agateo Tecnologia, CNPJ 41.030.944/0001-99 (“Agateo”).

Nuncie is a product of Agateo. The company's corporate website is at https://agateo.com.br.

By accessing the website or using the product, you agree to these terms, to the Privacy Policy and to the Data Deletion Policy.

The product

Nuncie is software as a service for creating and running ad campaigns through Meta's official ads API (Facebook and Instagram). The app is at https://app.nuncie.com.

The product website presents Nuncie and its contact channels. It does not require an account.

Account

To use the product you must have full legal capacity, provide truthful information and keep your credentials safe. The account belongs to the person or company that subscribed to it. You are responsible for the users you authorize.

The product is not intended for people under 18.

Meta API

Nuncie depends on Meta's platforms, including the Marketing API and, when the lead flow uses WhatsApp, the WhatsApp Business platform. Use is also subject to Meta's terms, policies and limits.

Agateo does not control Meta. Unavailability, policy changes, ad account limits or blocks applied by Meta may affect the product. That is not, in itself, a failure by Agateo.

You authorize Agateo to connect, on your behalf, the Meta accounts, Pages and permissions needed to provide the service. Tokens and identifiers from this connection are used only to operate the contracted product.

Content and contacts

You are responsible for the content of the campaigns, the creatives, the audiences and the personal data of third parties that you enter into the product.

You declare that you have a legal basis to process that data and to send communications, including consent when the law or Meta's policy requires it. Using the product for spam, fraud, unlawful content, prohibited discrimination or any practice forbidden by Meta is not allowed.

In this relationship, you are the controller of your contacts' and customers' data. Agateo processes that data as a processor, to provide the service. Your own account data is controlled by Agateo, as described in the Privacy Policy.

Plans and payment

Nuncie may be offered in free and paid plans. The price, term and conditions of the plan are shown in the product before confirmation. Outside Brazil, the Pro plan costs US$ 19 per month and the Agency plan costs US$ 59 per month for up to 5 clients, plus US$ 9 per month for each extra client. Payments for paid plans are processed by a payment processor.

Tax obligations arising from your activity remain with you. Agateo's tax obligations remain with Agateo.

Intellectual property

The website, the software, the Nuncie brand and Agateo's materials belong to Agateo or to their respective owners. These terms grant a limited, non-exclusive and non-transferable license to use the product according to the subscription.

The content you send remains yours. You grant Agateo a license to host, process and transmit that content only to provide the service, comply with the law and maintain security.

Acceptable use

You may not:

• access another customer's area, account or data;
• interfere with the infrastructure or circumvent technical security limits;
• reverse engineer beyond what the law allows;
• resell access without Agateo's written authorization;
• use the product to violate the LGPD, the Marco Civil da Internet or Meta's rules.

AI creatives

The Creatives module makes images and videos with artificial intelligence from what you ask in the chat. Generation is done by AI providers hired by Agateo. Each creation uses credits, shown before generating; if a creation fails, the credits come back.

By using the module, you declare that:

• you have the right to use the images you upload (logo, photos of the product, the place and people) and, if someone appears in them, that person's authorization;
• you will not ask for real or famous people without authorization, third-party brands, misleading before-and-after, health or money promises, adult or violent content, or anything Meta's advertising policies forbid;
• you review each creative before using it in an ad.

Such requests are refused automatically, without using credits, and are recorded. Repeated attempts may pause creation on the account.

The generated images and videos are yours to use in your ads and your business. Because they are made by AI, similar results may appear for other people, and there is no guarantee of exclusivity or of registration as your own work.

Meta may require or apply the label for content created or altered by AI ("AI info"). In ads about social issues, elections or politics, disclosing the use of AI is mandatory and is your responsibility.

The files stay in our storage. When you delete the account, the creatives and the brand kit are deleted.

Availability

Agateo uses reasonable efforts to keep the product available. Uninterrupted operation is not guaranteed. Maintenance, third-party failures and force majeure may interrupt the service.

Liability

To the extent permitted by Brazilian law, Agateo is not liable for lost profits, losses caused by third parties, Meta's decisions or use of the product contrary to these terms.

Nothing in these terms excludes any non-waivable consumer right, when the relationship is a consumer relationship, nor liability for willful misconduct or gross negligence.

Suspension and termination

You may close your account through the product's channels or by email at contato@nuncie.com. Agateo may suspend or terminate access in the event of a violation of these terms, the law or Meta's rules, and also to protect customers and the infrastructure.

Termination does not cancel amounts already due nor data that the law requires to be kept. Deletion of personal data follows the Data Deletion Policy.

Changes

Agateo may update these terms. The current version is on this page, with the date at the top. Use after publication counts as acknowledgment of the new version. If the change affects an ongoing paid contract, Agateo gives reasonable advance notice to the account's email.

Governing law and venue

These terms are governed by the laws of the Federative Republic of Brazil. The courts of the district of Agateo's domicile are chosen as the venue, except for the venue of the consumer's domicile when the law guarantees it.
